This policy explains how photos taken and shared inside Sher Rooms may be used for marketing purposes, and what control you have over that use. It sits alongside our main Privacy Policy and Terms of Service and should be read together with them. Where this policy and the Privacy Policy conflict on image handling specifically, this policy governs.
This policy applies to any photo that exists inside a Sher Room, regardless of who took it, including photos a member takes of themselves, photos of a member taken by another Room member, and photos uploaded from a device gallery where the Room permits gallery uploads.
Because Sher is a collaborative photo app, any member of a Room can potentially capture and upload an image that includes you. This policy applies equally to photos you took yourself and photos others took that show you.
Photos in a Sher Room may be considered for marketing use in two distinct ways, which are handled separately.
Mandates Technology LTD may wish to use a photo in Sher's own promotional materials, such as app store listings, our website, or our social media accounts.
The host of an event may wish to use photos from their Room to promote a future event of theirs, for example a community organiser sharing highlights from one gathering to promote the next. This use is separate from Sher's own marketing and is governed by the additional terms in Section 6 below.
In both cases, marketing use is off by default and requires affirmative opt in consent as described in Section 4.
Sher will not use any photo from a Room for marketing purposes, and will not permit a host to use a photo for their own marketing purposes, unless the applicable person has affirmatively opted in. This is an opt in system, marketing use is off by default.
For a self captured photo where you are the only identifiable person, your consent alone is sufficient.
For a photo that includes other identifiable people, whether taken by you or by someone else, consent is required from every identifiable person shown, not just the photo's uploader. A photo will only be eligible for marketing use, by Sher or by a host, once each identifiable person in it has separately opted in.
The person who captured or uploaded a photo does not, by that act alone, grant marketing rights over the people depicted in it. Uploading is not consent on behalf of others.
Consent is collected through an explicit, separate marketing consent prompt inside the app, never bundled into general account sign up or Room join consent. You can opt in per event, per Room, or account wide, depending on the option presented at the time. Consent must be a clear affirmative action, such as tapping Allow. Silence, inactivity, or a pre ticked box does not count as consent.
Where a photo may be used by a host for their own marketing under Section 6, the consent prompt will state clearly that the photo may be used by the event host, separately from any consent for Sher's own marketing use.
You may withdraw marketing consent at any time from Settings, Privacy, Marketing Permissions. Withdrawal stops future use of your image in new marketing materials. It does not retroactively pull the image from materials already published or distributed before withdrawal, see Section 7.
If you are identifiable in a photo but are not the uploader, you can still find and flag that photo for removal from marketing consideration via Settings, Privacy, Photos of Me, or by contacting us using the details in Section 10.
Marketing use may include Sher's own promotional materials such as app store listings, website, blog, and case studies, social media posts by Sher or Mandates Technology LTD, paid advertising, and press or investor materials. Where a host has separate marketing rights under Section 6, it also includes an event host's own promotional materials for their future events.
Marketing use does not include normal in-app display of photos to Room members, which is core app functionality governed by the Terms of Service, content moderation, fraud prevention, or legal compliance review, or internal product development, debugging, or quality assurance.
A Room host or organiser cannot grant marketing consent on behalf of Room members, whether for Sher's marketing or their own. Each depicted individual must separately opt in before a host may use a photo showing them for the host's own marketing.
When a member opts in to marketing use for a Room, they will be shown whether that consent applies to Sher's own marketing, the host's marketing for future events, or both, and can choose accordingly.
Only photos where every identifiable person has opted in specifically to host marketing use will be made available to the host for that purpose. Sher may provide the host with a means to access these specific opted in photos, separate from the standard Room gallery.
If an event has its own photography or media release, for example a wedding, corporate event, or conference with its own consent forms, that release is between the host and their guests and is separate from Sher's marketing consent system. A host's external release does not substitute for the opt in consent described in this policy, and does not grant the host rights to use a member's Sher photos for marketing without that member's opt in through the app.
Marketing consent remains valid until you withdraw it or your account is deleted. On withdrawal or account deletion, we will stop using your image in any new marketing materials immediately, and make reasonable efforts to remove your image from actively controlled marketing channels, including a host's materials where we are able to notify them, within 30 days. We will not be able to recall materials already distributed to or published by third parties before the withdrawal date, such as a media outlet that already ran a story, or a printed campaign already in circulation.
Sher requires all users to meet the minimum age specified in our Terms of Service and Privacy Policy. If a minor appears in a photo, that minor's image will not be used for marketing purposes, by Sher or by a host, under any circumstance, regardless of any other member's consent, unless separate, explicit parental or guardian consent is obtained through a verified process outside the standard in-app flow. Absent that, minors' images are excluded from marketing use by default and cannot be opted in through the standard flow.
Photos flagged for marketing use may be stored, processed, and reviewed separately from the standard Room gallery storage described in our Privacy Policy, for as long as needed to support the marketing use and for a reasonable period afterward for record keeping of consent.
We do not sell photos or personal images to third parties. Marketing use is limited to Sher's and Mandates Technology LTD's own promotional activity and, where applicable, an event host's own future promotional use, strictly under the opt in consent described in this policy.
Standard Room gallery photos that have not been opted in remain governed by our Privacy Policy and are subject to normal Room retention and deletion rules, unaffected by this policy.
You can at any time view which of your photos, if any, have been flagged for marketing use, grant or withdraw marketing consent, request removal of your image from a specific piece of marketing material, and ask who has consented in a photo that includes you.

We may update this policy as Sher's features evolve. Material changes, such as changes that expand what counts as marketing use or that change the consent model from opt in, will be notified in-app and will not apply retroactively to previously opted in photos without renewed consent.
This policy should be read together with Sher's Privacy Policy, which governs general handling of personal data and photos, Sher's Terms of Service, which governs account eligibility, acceptable use, and Room participation, and any event specific consent forms provided by a host, which are separate from and do not override this policy.
